The End of the Line
"My wife and I first became involved in Timeshare ownership in 1984 through purchasing a week with Barratt International resorts. We thoroughly enjoyed our week and managed to exchange to all the Barratt resorts in Britain as well as having some great weeks at our home resort.
We visited a presentation given by the Grand Vacation Club in 1997 and purchased some points. In 2001 we transferred our Barratt week to GVC, thus giving us more points and more flexibility.
GVC, after a number of name changes, eventually became Diamond Resorts International and we enjoyed many good holidays in Britain, Europe and the USA. We thoroughly enjoyed the holidays and felt that we were getting good value for money. We began to notice, however, that we were being subjected to the almost obligatory “information meeting” when we visited DRI resorts. These meetings, whilst beginning in a friendly, chatty manner, frequently descended into a long presentation which resulted in an “offer of the day” to buy more points.
Normally, we resisted all offers as we were happy with our number of points, although we did complain that there were very few destinations in Europe which really interested us.
Getting out is not easy
We began to ask questions about the possibility of getting out of the Club and, eventually, in 2015, we were informed that there was a mechanism to do this. Firstly, however, we had to become Silver Members and were told that we “had” to buy 5000 points (although, technically, we were only 1500 short of Silver at the time). We decided to go ahead as we were very keen to find a way of terminating our contract.
Whilst waiting for the two years of Silver membership which we were told was required before we could begin proceedings to leave DRI (we later found this to be untrue). Claims Solution Group, who were based in Aberfeldy, offered us a free consultation. Strangely enough, we had been in Aberfeldy for a short break and had noticed the office. We decided to take them up on their offer of a meeting to discuss the possibility of claiming back mis-sold points and finding a way of terminating our contract with DRI.
A very positive meeting
We visited Aberfeldy and had a very positive meeting with Bryan Wilson (Business Director) and Anne Ormond (Senior Consultant). The meeting was conducted in a very professional manner, something which has continued throughout all of our other dealings with them. Bryan has always kept us fully informed of the up to date situation in regard to our claim and has worked closely with their legal team.
So far we have received a refund of the sum of money which we were required to pay in 2015 to become Silver members and our contract with DRI has been terminated.
There are costs involved in this process, but that has to be expected. Suffice to say that, the amount of paperwork and legal dealings which have been undertaken by this group of people, could not have been completed successfully by an individual and they have taken all of the pressure from us.
I would thoroughly recommend talking to Bryan and his team – it is unlike most meetings with Timeshare personnel. They have always kept us abreast of the situation and have done exactly as they promised. We feel very relieved to have been able to terminate our contract at a time suitable to us because of advancing years and some health related problems."

Case Against ReClaimGC
In September of 2016 we made contact with Bryan Wilson from Claims Solution Group to discuss our situation with Diamond Resorts and ReClaimGC. Diamond Resorts are a Timeshare Company which we wanted to terminate our contract with and ReClaimGC were Spanish Lawyers we hired to achieve this termination. It became very clear after a period of approximately 4 years that the Spanish Lawyers were not capable of managing our case even after the substantial sum of money we paid them.
Following in-depth discussions with Bryan he created a clear plan of action to help us break our contract with Diamond Resorts and to get Compensation from ReClaimGC, as outlined below:
- Terminate Contract with Diamond Resorts
- Seek compensation from ReClaimGC
- Seek compensation from Diamond Resorts
Bryan and his team of lawyers then began to build our cases against Diamond Resorts and ReClaimGC and executed the appropriate steps to win our cases.
After approximately 3 months we received confirmation from the lawyer working on the Diamond Resorts case that they had successfully terminated our contract with Diamond Resorts. During this period we received a professional service from the lawyer leading up to this successful outcome.
After approximately 9 months we received confirmation from the lawyer working on the ReClaimGC case that we had won our case. This involved us receiving a full refund of our fees paid to the Spanish Lawyers and also interest on these fees. An excellent outcome and again we received a professional service from the lawyer.
Our case to seek compensation from Diamond Resorts is nearing completion and the lawyer is extremely confident of success.

"Recently my wife died after a long illness and I reluctantly decided I could no longer make the annual pilgrimage to Loch Rannoch. We had enjoyed many years there and it was a highlight of our year. I tried the usual routes for having the Holiday Certificate reassigned but to no avail.
