Section 75 Claims

Under Section 75 of the Consumer Credit Act 1974, the credit card company is jointly and severally liable for any breach of contract or misrepresentation by the retailer or trader. Put simply this means your card provider is just as responsible as the retailer for the goods or service in question.

What is Section 75?

Section 75 is the part of the Consumer Credit Act that details your legal right to protection when you when you make a purchase on your credit card. If you buy something that costs between £100 and £30,000, you can often claim your money back from the card provider if something goes wrong.

When can I claim?

You can make a claim for most items or services with a value between £100 and £30,000 when purchased on a credit card. In some cases store cards, instalment credit agreements and some finance deals are also covered. It is also worth noting that when only the deposit was paid using a credit card the full purchase value is still covered under Section 75. Transactions abroad and from overseas suppliers are also covered just as they would be in the UK.

What do I need to start the process?

In order to make a claim we would need to know:

  • The name of the retailer
  • The service or product you purchased
  • How much it cost
  • Any associated costs you want to claim back
  • What was wrong your purchase
  • The date you made the purchase
  • Details of any previous attempts you have made to claim

It is also worth noting that Section 75 will not apply when:
• You pay by cash, cheque, debit card, charge card or prepaid card (including cash you have withdrawn from your credit card)
• You find the item or product cheaper elsewhere
• If you change your mind
• When you buy land or make purchases on behalf of a business
